By accessing or using GDS ONE, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you disagree with any part of these terms, you should not use our services.

We reserve the right to modify these terms at any time. Changes will take effect immediately upon posting on our website.

GDS ONE is a cloud-based ERP (Enterprise Resource Planning) system that provides:

• Accounting and financial management

• Inventory and warehouse control

• Sales and CRM management

• Purchasing and supplier management

• Production and manufacturing

• Business Intelligence and reporting

• And other business modules

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

To use GDS ONE, you must:

• Be at least 18 years old

• Provide accurate and complete information

• Maintain the security of your account

• Notify us immediately of any unauthorized use

You are responsible for all activities that occur under your account. You may not transfer your account to another person without our prior written consent.

GDS ONE offers different subscription plans:

• Starter: For small businesses (1-10 users)

• Professional: For growing companies (11-50 users)

• Enterprise: For large enterprises (50+ users)

Payment terms:

• Payments are processed monthly or annually according to your plan

• All prices are in Guatemalan Quetzales (GTQ)

• Applicable taxes will be added according to jurisdiction

• Payments are non-refundable except as required by law

• You may cancel your subscription at any time

• Cancellation will be effective at the end of the current billing period

By using GDS ONE, you agree NOT to:

• Violate applicable laws or regulations

• Infringe intellectual property rights

• Transmit malware, viruses, or harmful code

• Attempt unauthorized access to our systems

• Reverse engineer the software

• Use the service for fraudulent activities

• Overload or interfere with our servers

• Resell or redistribute the service without authorization

We reserve the right to suspend or terminate your account if you violate these terms.

GDS ONE and all its content, features, and functionality are owned by Grupo GDS and protected by:

• Copyright

• Trademarks

• Patents

• Trade secrets

• Other intellectual property laws

You may not copy, modify, distribute, sell, or lease any part of our services without our express written permission.

Your Data:

You retain all rights to the data you enter into GDS ONE. We grant you a license to use the software, but your data remains yours.

We strive to keep GDS ONE available 24/7, but we do not guarantee:

• Uninterrupted access to the service

• Error-free operation

• Immediate correction of defects

Technical Support:

• Starter: Email support (48-hour response)

• Professional: Priority support (24-hour response)

• Enterprise: Dedicated 24/7 support with guaranteed SLA

Scheduled maintenance will be notified at least 48 hours in advance.

We implement security measures to protect your data:

• Automatic daily backups

• Data encryption in transit and at rest

• Role-based access controls

• 24/7 security monitoring

• ISO 27001 compliance

However, no system is 100% secure. You are responsible for:

• Keeping credentials secure

• Configuring user permissions appropriately

• Maintaining additional backups if you deem necessary

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

GDS ONE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

WE WILL NOT BE LIABLE FOR:

• Loss of profits, data, or business opportunities

• Indirect, incidental, or consequential damages

• Service interruptions

• Errors or inaccuracies in content

• Unauthorized access to your data

OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID BY YOU IN THE LAST 12 MONTHS.

You agree to indemnify and hold harmless GDS ONE, its directors, employees, and agents from any claim, damage, loss, or expense (including legal fees) arising from:

• Your use of the service

• Your violation of these terms

• Your violation of third-party rights

• Any content you provide

You may terminate your account at any time by:

• Canceling your subscription from the control panel

• Contacting our support team

We may terminate or suspend your account if:

• You violate these terms

• You fail to pay applicable fees

• Your use puts our systems at risk

• Required by law

Upon termination:

• Your access to the service will cease immediately

• Your data will be retained for 30 days for recovery

• After 30 days, data will be permanently deleted

• No refunds will be issued for payments already made

These terms are governed by the laws of Guatemala.

Any dispute will be resolved in the courts of Guatemala, Guatemala City.

If any provision of these terms is deemed invalid, the other provisions will remain in full force.

We reserve the right to:

• Modify or discontinue features

• Change prices with 30 days' notice

• Update these terms at any time

Significant changes will be notified by email or through a notice in the service.
